Privacy policy
Mingled is a handmade jewellery studio in Newcastle, NSW. This policy explains what personal information we collect, why, where it's stored, who we share it with and what you can do about it.
It covers our website (mingled.com.au), our email and SMS lists, our social media and advertising, orders through Etsy and Faire, and sales at markets. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth) and, for customers in New Zealand, the Privacy Act 2020 (NZ).
In this policy, "we", "us" and "our" means Mingled. "Personal information" means information that identifies you or could reasonably identify you.
What we collect
We only collect what we need to sell you jewellery, get it to you and keep in touch if you've asked us to.

We don't collect sensitive information (like health information or religious beliefs) and we don't ask for it.
Mingled's website uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages by text message.
How we collect it
Mostly from you, directly: when you check out, create an account, fill in a sign-up form or pop-up, enter a giveaway, email or message us, or buy from us at a market.
Some is collected automatically through cookies, pixels and similar tools when you visit our site or open our emails (see Cookies, pixels and browsing history below).
We also receive some information from third parties:
- Etsy and Faire pass on your name, delivery address and order details when you buy through them, so we can fulfil your order.
- Meta (Facebook and Instagram), Google and Pinterest give us reports on how our ads perform. These are mostly aggregated and don't usually identify you.
- Market payment terminals record the transaction and, if you ask for one, your email for a receipt.
How we use it
We use your personal information to:
- process, pack and ship your order, handle returns and send order and shipping updates
- answer your questions and look after you if something goes wrong
- send you marketing emails and texts, but only if you've agreed to receive them
- send reminders about items you've left in your cart or products you've viewed, if you're on our email or SMS list
- show you Mingled ads on Facebook, Instagram, Google and Pinterest, including ads based on what you looked at on our site
- understand how people use our site so we can improve it and our range
- spot and prevent fraud and misuse
- manage wholesale accounts and stockist orders
- meet our legal obligations, including tax and consumer law record-keeping
We won't use your information for anything unrelated to these purposes unless you'd reasonably expect it, you've agreed, or the law requires or allows it.
We do not sell, rent or trade your personal information.
Email and SMS marketing
We only send marketing emails or texts if you've opted in, for example by ticking the box at checkout or signing up through a form on our site or at a market. We record when and how you gave consent.
We use Klaviyo to store our subscriber list and send our emails and texts. Klaviyo holds your email address, mobile number, consent records, which messages you open and click, and your browsing and order activity on our site. We use that activity to send you messages that are more relevant, like a reminder about earrings you looked at or left in your cart.
Your mobile number is used only for Mingled texts. We don't share it with anyone for their own marketing.
Unsubscribing: every email has an unsubscribe link, and you can reply STOP to any text. We'll process your request within 5 working days. You can also email us at hello@mingled.com.au. If you unsubscribe from marketing, you'll still get messages about orders you've placed.
Standard message rates from your phone provider may apply to texts.
Cookies, pixels and browsing history
Cookies are small files saved by your browser. Pixels and tags are small bits of code that record when you visit a page, view a product or open an email. We use them to keep your cart working, understand how our site is used, and show you Mingled ads after you've visited.

When you're shown our ads on social media, the platform may match a hashed (scrambled) version of your email or phone number against its own users. The platform can't read the original details and we don't get your social media data back.
Your choices:
- Block or delete cookies in your browser settings. The site will still work, but your cart may not save.
- Opt out of Google Analytics: tools.google.com/dlpage/gaoptout
- Manage Google ads: myadcenter.google.com
- Manage Facebook and Instagram ads: facebook.com/adpreferences
- Manage Pinterest ads: in your Pinterest account under Settings > Privacy and data
Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Storing information overseas
Most of the tools we use are run by overseas companies, so your personal information is likely to be stored or accessed outside Australia, mainly in:
- the United States (Klaviyo, Google, Meta, Pinterest, PayPal, Etsy, Faire)
- Canada (Shopify)
- Ireland and other EU countries (some Meta and Google services)
These providers may also use data centres in other countries. We choose established providers with published privacy and security commitments, and we take reasonable steps to make sure they handle your information consistently with the Australian Privacy Principles.
Automated decisions
Shopify and our payment providers automatically check each order for signs of fraud, using details like your IP address, billing and delivery addresses and payment information. If an order is flagged as high risk, it may be held or cancelled and refunded. We review flagged orders ourselves before cancelling wherever we can.
We also use automated tools to decide which marketing emails, texts and ads you see, based on what you've viewed or bought. These don't affect your legal rights, prices or ability to buy from us.
If you think an order was cancelled by mistake, contact us and a real person will look at it.
Keeping your information safe
Your information is stored electronically in the systems listed above. Our providers use encryption, secure data centres and access controls. On our side, we use strong unique passwords and two-factor authentication on our accounts, limit access to people who need it, and don't keep card details anywhere. Paper records from markets or wholesale orders are kept in our studio and shredded when no longer needed.
No system is completely secure. If a data breach is likely to cause you serious harm, we'll tell you and, where required, the Office of the Australian Information Commissioner (or the NZ Privacy Commissioner), and explain what you can do to protect yourself.
How long we keep it
We keep personal information only as long as we need it, then delete or de-identify it.
|
Information |
How long |
|---|---|
|
Order and payment records |
5 years after the order, because Australian tax law requires it |
|
Customer accounts |
Until you ask us to close your account, or after 3 years with no activity |
|
Email and SMS subscriber details |
While you're subscribed. After you unsubscribe, we keep a suppression record of your email or number so we don't contact you again |
|
Browsing and viewing history |
Up to 2 years in our analytics and marketing tools |
|
Messages and enquiries |
Up to 2 years |
If you ask us to delete your information, we'll delete what we can. Some records, like tax invoices, we have to keep for the legally required period.
Your rights
You can ask us at any time to:
- tell you what personal information we hold about you
- give you a copy of it
- correct anything that's wrong or out of date
- delete it (subject to the record-keeping rules above)
- stop sending you marketing
Email hello@mingled.com.au. We may need to confirm your identity first. We'll respond within 30 days, and it won't cost you anything. If we can't do what you've asked, we'll tell you why in writing.
You can browse our site without telling us who you are. To buy something we'll need your name, contact and delivery details, and at markets you can buy without giving us any details at all.
Complaints
If you're unhappy with how we've handled your personal information, email hello@mingled.com.au with the details. We'll acknowledge your complaint within 7 days and aim to resolve it within 30 days.
If you're not satisfied with our response, you can contact:
- Australia: the Office of the Australian Information Commissioner, oaic.gov.au, 1300 363 992
- New Zealand: the Office of the Privacy Commissioner, privacy.org.nz, 0800 803 909
- Spam complaints (Australia): the Australian Communications and Media Authority, acma.gov.au
Children
Our site and marketing are for adults. We don't knowingly collect personal information from anyone under 16. If you think a child has given us their details, let us know and we'll delete them.
Changes to this policy
We'll update this policy when our tools, practices or the law change. The latest version is always on this page, with the date it was last updated. If we make a big change to how we use your information, we'll let subscribers know by email.
